How SunShare Philippines Inc. collects, uses, and protects your personal information — aligned with the Philippine Data Privacy Act (RA 10173).

Overview

SunShare Philippines Inc. ("SunShare", "we", "our", or "us") is committed to protecting your privacy and the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our services, website, and platform.

This policy is aligned with the Philippine Data Privacy Act of 2012 (Republic Act 10173) and its Implementing Rules and Regulations (IRR). We are registered with the National Privacy Commission (NPC) and take all reasonable steps to comply with applicable data protection laws.

Plain language summary: We collect only what we need to deliver your energy service and improve it. We never sell your personal data. You have the right to access, correct, and delete your information. If you have questions, email us at privacy@sunshare.ph.

Information We Collect

Account and identity information

When you register for SunShare or submit an eligibility application, we collect:

  • Full legal name and date of birth
  • Government-issued ID number and type
  • Contact details: email address, mobile number, mailing address
  • Property information: address, meter number, account number with your distribution utility
  • Customer type (residential, commercial, industrial)

Electricity consumption data

To deliver our service and calculate your savings, we collect and process:

  • Historical and current electricity consumption (kWh) from your distribution utility
  • Billing amounts and rate components from uploaded electricity bills
  • Meter reading data received from your distribution utility
  • Demand profiles and usage patterns (where available)

Usage data from our platform

When you use the SunShare website or dashboard, we automatically collect:

  • IP address, browser type, and device information
  • Pages visited, features used, and time spent on the platform
  • Referring URLs and search terms
  • Cookies and similar tracking technologies (see Section 7)

Communications

If you contact us by email, phone, or through our support system, we retain records of those communications to resolve your inquiry and improve our service.

How We Use Your Information

We use your personal data only for the purposes described below. We rely on one of the following legal bases for each use: performance of contract (delivering your energy service), legal obligation (ERC regulatory requirements), or legitimate interest (improving our service).

  • Service delivery: Processing your application, managing your supply contract, calculating billing, and coordinating with your distribution utility
  • Savings analysis: Analyzing your consumption data to generate personalized savings projections and recommendations
  • Regulatory compliance: Submitting required reports to the Energy Regulatory Commission (ERC), Department of Energy (DOE), and other regulators
  • Account management: Sending billing statements, service notifications, and account-related communications
  • Platform improvement: Analyzing usage patterns to improve the SunShare dashboard and website
  • Marketing (with consent): Sending news, insights, and offers — only if you opt in. You can unsubscribe at any time.

We never use your consumption data or personal information for purposes unrelated to energy service delivery without your explicit consent.

How We Share Your Information

We do not sell, rent, or trade your personal information. We share data only in the following circumstances:

Distribution utilities and energy market participants

To process supply switches and deliver your service, we share necessary account information with your distribution utility (e.g., Meralco, VECO) and, where required, with the National Grid Corporation of the Philippines (NGCP) and the Independent Electricity Market Operator of the Philippines (IEMOP).

Regulatory bodies

We submit required reports and data to the Energy Regulatory Commission (ERC), Department of Energy (DOE), and other government bodies as mandated by Philippine energy law.

Service providers

We use trusted third-party service providers for cloud hosting, payment processing, and communications infrastructure. These providers are contractually bound to handle your data only according to our instructions and applicable privacy law.

Legal requirements

We may disclose your information if required by law, court order, or government authority, or to protect the rights, property, or safety of SunShare, our members, or the public.

Aggregated, anonymized data

We may share aggregated, de-identified data (e.g., total network savings, average consumption by region) for research, reporting, or public interest purposes. This data cannot be used to identify you.

Your Data Rights

Under the Philippine Data Privacy Act (RA 10173), you have the following rights regarding your personal data:

  • Right to be informed: You have the right to know what personal data we hold about you and how we use it.
  • Right to access: You may request a copy of the personal data we hold about you at any time.
  • Right to correction: You may request that we correct any inaccurate or incomplete personal data.
  • Right to erasure: You may request deletion of your personal data, subject to our legal and regulatory retention obligations.
  • Right to object: You may object to our processing of your personal data for direct marketing purposes at any time.
  • Right to data portability: You may request your personal data in a structured, machine-readable format.
  • Right to file a complaint: You may lodge a complaint with the National Privacy Commission at privacy.gov.ph.

To exercise any of these rights, contact our Data Protection Officer at privacy@sunshare.ph. We will respond within 15 business days.

Data Retention

We retain your personal data for as long as necessary to deliver our service and meet our legal obligations:

  • Active account data: Retained for the duration of your service agreement plus 5 years after termination (as required by ERC record-keeping rules)
  • Consumption and billing data: Retained for 7 years in compliance with Philippine accounting and energy regulations
  • Support communications: Retained for 3 years after the communication
  • Marketing consent records: Retained for as long as you remain on our mailing list, plus 1 year after unsubscribing

Cookies and Tracking

Our website uses cookies and similar technologies to improve your browsing experience and analyze usage. We use:

  • Essential cookies: Required for the website to function (login sessions, security). Cannot be disabled.
  • Analytics cookies: Help us understand how visitors use our site. We use anonymized analytics only.
  • Preference cookies: Remember your settings and preferences across visits.

You can control cookie settings through your browser preferences. Disabling non-essential cookies will not affect your ability to use the core SunShare service.

Data Security

We implement industry-standard security measures to protect your personal data, including:

  • TLS/SSL encryption for all data in transit
  • Encryption at rest for sensitive personal and consumption data
  • Role-based access controls limiting employee access to personal data
  • Regular security audits and penetration testing
  • Incident response procedures aligned with NPC notification requirements

In the event of a data breach that may affect your rights and freedoms, we will notify the National Privacy Commission within 72 hours and inform affected individuals as required by law.
